Please read these terms carefully before using Bloom. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use Bloom.
1. About These Terms
These Terms of Service ("Terms") are a legal agreement between you and Robert Hasna ("we," "us," "our"), an individual based in Romania who develops and operates Bloom.
These Terms govern your use of the Bloom mobile application and related services (together, the "Service"). They apply alongside our Privacy Policy, which explains how we handle your data.
2. Eligibility
To use Bloom, you must:
- Be at least 18 years old.
- Have the legal capacity to enter into a binding agreement.
- Provide accurate information during registration.
We verify your age during registration. If we discover that an account was created by someone under 18, we will delete it and all associated data.
3. Your Account
You are responsible for:
- Keeping your login credentials secure. Do not share your password with anyone.
- All activity that occurs under your account.
- Notifying us promptly at hasna.robert@gmail.com if you suspect unauthorized access to your account.
You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.
4. The Service
Bloom is a face timelapse application. The Service allows you to:
- Upload photos of faces (yours or your children's).
- Have those photos automatically processed — faces are detected, aligned, and cropped using AI.
- Generate timelapse videos from your processed photos.
- Customize video settings such as speed, quality, and resolution.
- Track multiple people (e.g., multiple children) with separate timelapses for each.
- Receive optional daily reminders to take a photo.
Photos are uploaded to and processed on our cloud servers. They are not processed on your device. For full details on how your data is handled, see our Privacy Policy.
5. Your Content
You own your content. The photos you upload and the videos Bloom generates from them belong to you. We do not claim any ownership over your content.
By uploading content to Bloom, you grant us a limited, non-exclusive license to store, process, and transform your photos solely for the purpose of providing the Service to you. This includes:
- Storing your original photos on our servers.
- Running face detection and alignment on your photos.
- Generating cropped images and timelapse videos.
This license exists only to operate the Service. We will not use your content for advertising, marketing, training AI models, or any purpose unrelated to providing Bloom to you. This license ends when you delete your content or your account.
6. Acceptable Use
When using Bloom, you agree not to:
- Upload photos of people without their consent — You must have the right to photograph and upload images of any person whose photos you add to Bloom. For children, this means you must be their parent or legal guardian.
- Upload inappropriate content — Do not upload images that are violent, sexually explicit, illegal, or otherwise harmful.
- Use the Service for surveillance or identification — Bloom is for creating personal face timelapses, not for tracking, monitoring, or identifying individuals without their knowledge.
- Attempt to access other users' data — Do not try to access, modify, or delete data belonging to other users.
- Interfere with the Service — Do not attempt to disrupt, overload, or compromise the security of the Service or its infrastructure.
- Reverse engineer the Service — Do not decompile, disassemble, or attempt to extract the source code of the app or its processing systems.
- Use the Service for commercial purposes — Bloom is for personal use. Do not resell access or use it to provide services to third parties.
We reserve the right to suspend or terminate accounts that violate these rules.
7. Parental Authority and Children's Photos
Bloom is intended for parents and guardians to create face timelapses of their children. By uploading photos of a child, you represent and warrant that:
- You are the child's parent or legal guardian.
- You have the legal authority to consent to the processing of the child's photos on their behalf.
- You understand that the child's photos will be uploaded to our servers, processed using AI-powered face detection, and stored as described in our Privacy Policy.
You accept full responsibility for any content you upload to Bloom, including photos of children. If we receive a credible claim that photos were uploaded without proper parental authority or consent, we may remove the content and suspend the account.
8. Service Limitations
We strive to provide a reliable service, but there are inherent limitations you should be aware of:
- Face detection is not perfect. Our system may not detect a face in every photo — for example, if the face is partially obscured, at an extreme angle, or in poor lighting. Photos where no face is detected will not be included in your timelapse.
- Processing takes time. Photo processing and video generation happen automatically but are not instant. Processing times may vary depending on server load.
- The Service may have downtime. We may need to take the Service offline temporarily for maintenance, updates, or technical issues. We will try to minimize disruptions but cannot guarantee 100% availability.
- Video results may vary. The quality of your timelapse depends on the consistency and quality of the photos you upload. Different lighting, angles, and expressions will affect the final result.
- We do not guarantee data preservation beyond our stated security measures. While we take reasonable steps to protect your data (see our Privacy Policy), no system is immune to failure. We recommend keeping copies of important photos on your own device.
9. Account Termination and Deletion
Deletion by you
You can delete your account at any time from Settings → Delete Account in the app. This permanently deletes all your data, including photos, videos, and account information. This action cannot be undone.
Termination by us
We may suspend or terminate your account if:
- You violate these Terms.
- You use the Service in a way that could harm other users or our infrastructure.
- We are required to do so by law.
If we terminate your account, we will delete your data in accordance with our Privacy Policy. Where feasible and not prohibited by law, we will notify you before or at the time of termination.
Effect of termination
Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive (such as Limitation of Liability, Indemnification, and Governing Law) will remain in effect.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising from your use of or inability to use the Service.
- Our total aggregate liability for any claims arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Content you upload to Bloom.
- Your violation of these Terms.
- Your violation of any third party's rights, including uploading photos of someone without proper authority or consent.
12. Governing Law and Disputes
These Terms are governed by the laws of Romania, without regard to conflict-of-law principles.
If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.
We encourage you to contact us first at hasna.robert@gmail.com to resolve any disputes informally. If a dispute cannot be resolved informally, it shall be submitted to the competent courts in Romania.
If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform.
13. Force Majeure
We are not liable for any failure or delay in providing the Service caused by events beyond our reasonable control, including but not limited to: natural disasters, power outages, internet or telecommunications failures, infrastructure provider outages, government actions, cyberattacks, or pandemics.
14. Assignment
You may not transfer or assign your account or any rights under these Terms to another person.
We may assign or transfer these Terms (including your account and data) to a successor in the event of a merger, acquisition, sale of assets, or similar business transfer. If this happens, we will notify you and the new operator will be bound by these Terms and our Privacy Policy.
15. General Provisions
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. They replace any prior agreements or understandings, whether written or verbal.
Severability. If any provision of these Terms is found to be invalid or unenforceable by a court, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force.
No waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
16. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you through the app or by email before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
The "Last updated" date at the top of this page shows when these Terms were last revised.
